Off-duty officer charged with murder; affidavit indicates shooting wasn't self-defense

SUMMERVILLE, S.C. (WCIV) — Former Summerville Police Officer Anthony DeLustro made his first appearance in magistrate court after being charged with murder. The murder charges mean he'll eventually go to trial where he could face 30 years to a life sentence.

The South Carolina Law Enforcement Division (SLED) says DeLustro was off duty when he shot and killed 39-year-old Michael O’Neal in a Chick-fil-A parking lot on March 20.

After three weeks of an ongoing investigation, talking to eyewitnesses and collecting video evidence, SLED’s lengthy affidavit states DeLustro did not act out of self-defense. Records show O’Neal couldn’t have reasonably been seen as a threat since he was unarmed and tried to leave the altercation multiple times.

    The man was driving away. He was shot as he was driving away. This is murder. He needs to be held accountable. 30 years to life sounds justifiable.

    I could see a plea deal if there was only a small amount of evidence, but this guy climbed into another man's car and shot him. Why even talk about a plea deal?
  • Witnesses say the off duty cop was the primary aggressor ...that should be enough for the jury to put him away . We need to hold the really bad cops accountable because they make the good ones look bad and that's not good at all. Then you have a situation where no one wants to be a cop
