Freedom Under Law opposes Hlophe's JSC appointment

Freedom Under Law wants MK Party's John Hlophe's Judicial Service Commission
appointment to be reviewed. FUL's Chris Oxtoby says they're concerned
about Hlophe and his history of having been impeached. He claims his presence
will have an impact on the public's confidence in the JSC.

    I would prefer if such NGOs invest more resources and put more effort on bread and butter issues that affect the vulnerable in our communities, who are in dire need of legal representations to protect their rights.

  • I don't follow this legal argument because the provisions for the removal of a judge in the constitution are very similar to those for the removal of the president..And the Constitution is clear that no former President who has been impeached may represent parliament in any capacity, and yet the same constitution is deliberately silent on the consequences for an impeached judge. This leaves us to one conclusion, and that is the drafters of our constitution didn't find it necessary to exclude impeached judges from representing parliament in committees such as the JSC otherwise they would have said so as in the case of an impeached president.
