    She didn’t follow the proper quarantining procedures. They shouldn’t have got anything. It’s their own negligence that caused the problems🙄.

    I feel bad for the defendant. The plaintiffs were clearly careless by co-mingling the current fish residents and the new fish so quickly. Anyone who’s ever had an aquarium knows not to do that. However, the contract had a major loophole. Lesson for the defendant. He chose the right option to settle the case, though. I would not have sent more live fish to the plaintiffs.

    I do agree with one thing, if this woman claims he has been sending out sick fish for 10 years, she could have found that out before placing the order. I always do a quick Google search befor buying something new.

    I am part of the fish keeping community. This woman did the wrong thing. She should know better if she's been keeping Cichlids. They get stressed easily, so disease aside she should have quarantined them in a nearby tank before fully introducing them. Travel is stressful as it is. You have no idea what diseases may have presented during travel that were not obvious before they were shipped.

    The defendant was smart because he realized if he refunded their payment the JJ show would pay for it. If he replaced the fish it would likely come out of his pocket.

    2:35 They can't stay in the bags the way he ships them for two weeks. Correct, you're supposed to have a quarantine tank lady.

    They are in breach of the contract for not quarantining the fish, but he left a loophole that allows them to ask for replacement if they aren't happy. He needs to put terms to clause3

    I'm okay with him making the order right less than 10 days, but NO on the other fish she had... there's no way to prove it was the new fish that killed them. She clearly didn't quarantine

    You have to quarantine new fish. You don’t and this is the gamble you make.

    His website still says: 3. If you get an order of fish that you do not approve of, we ask that you DO NOT mail the live fish back to us. That is more stress than necessary on the fish and if they are alive and healthy, we request you keep them. We will credit you the proper amount or type of fish to fulfill our promise to you. The wording of that is very lose, such that, I could order a dozen purple fish, then tell him the color is not purple enough. Oh, yes there are bad reviews. Took me 5 seconds to find them.

    They were trying so hard to win, it's THEIR fault they killed their own fish. It's not his fault.
  • The seller made a good Choice. Sucks but I wouldn’t want to deal with those FISH KILLERS either.

    Them refusing to quarantine the fish is what resulted in their deaths and should have voided the contract that required him to repay them.

    That was an unexpected outcome. I thought the plaintiffs had no case because they didn't follow the guidelines. I wonder if defendant has altered the T&C of his online contract and removed any loopholes.

    This case would be a prime example of why it’s super important to always say less than necessary. Not only did she not read the terms of sale, she admitted to killing her own fish by not following the quarantining procedure. Then in addition to not thoroughly researching the business beforehand, they attempted to blame shift to absolve themselves of owner responsibility. Each time either she or her husband opened their mouths, they bolstered the case of the defendant and made themselves appear more negligent, uninformed, and spiteful. Simply re-reading the contract would’ve saved everyone a bunch of time and money. Well hey, 🤷🏾‍♂️ at least they got a free trip out the deal
